JUDGMENT / ORDER

These applications arise from the cases registered by the Chittur and Alathur police respectively, implicating the petitioner also as an accused. Crime No.1120 of 2013 is registered by the Chittur police for the offence punishable under Sec.420 of the Indian Penal Code and under various provisions of the Central Chit Funds Act. Crime No.1867 of 2013 is registered by the Alathur police for the offence punishable under Sec.420 r/w Sec.34 of the Penal Code.
2. Learned Public Prosecutor has opposed the applications.
It is submitted that petitioner is the Managing Partner of a chitty company engaged in conducting chitties. Many of the subscribers have preferred complaints regarding the chitty company cheating them. In Crime No.1120 of 2013, the de facto complainant is said to have suffered a loss of Rs.40,000/- while the aggrieved persons in Crime No.1867 of 2013 claimed to have suffered a total loss of Rs.8,00,000/-.
3. Learned counsel submits that the allegations are not true. Petitioner is only the driver of the first accused. He has no B.A.Nos.3849 and 3852 of 2014 2 connection with the chitty company. It is also submitted that the first accused was arrested and released on bail.
4. Alleged role of the petitioner, if any in the matter of running chitties is a matter to be investigated. Having regard to the nature of investigation required to be done, request for pre- arrest bail cannot be allowed. It is open to the petitioner to surrender before the officer(s) investigating the cases. In case of arrest, after interrogation is over, he shall be produced before the jurisdictional magistrate as early as possible.
The applications are disposed of with the above direction.
