2. The present application has been filed by the applicant - original appellant for joining the proposed respondents as a party stated in Para.11 on the grounds mentioned in the application.
3. Heard the learned Senior Counsel, Mr.P. C. Kavina with learned counsel, Mr.Amar D. Mithani for the applicant, learned counsel, Mr.Sachin D. Vasavada for respondent Nos.1 to 5 and learned counsel, Mr.P.R.Nanavati, who is appearing for the Gujarat Maritime Board.
4. In view of the submissions particularly referring to the judgment of the Hon'ble Apex Court in the case of Fertilizers & Chemicals Travancore Ltd. v. Regional Director, ESIC & Ors., reported in 2009 (11) Scale 766 referring to this very issue and also a subsequent judgment of the Hon'ble Apex Court in the case of Employees' State Insurance Corporation v. M/s. Bhakra Beas Management Board & Anr., reported in 2009 AIR SCW 7037, the present application for joining as a party the proposed respondents deserves to be allowed and accordingly, stands allowed. Prayer in terms of Para.12(b) is granted. The proposed parties stated in Para.11 are permitted to be joined as a party respondents. Learned Senior Counsel, Mr. P. C. Kavina appearing with learned counsel, Mr.A.D. Mithani for the applicant shall carry out the amendment within a week. Rule is made absolute.
