The petitioners herein are the six accused in CC 361/2014 of the Judicial First Class Magistrate Court - 1, Nedumangad. Crime in the said case was registered under Sections 143, 147, 148, 149, 341, 323 and 324 IPC read with Section 149 IPC on the complaint of one Shamnad. The petitioners now seek orders quashing the prosecution on the ground that they and the complainant have amicably settled the dispute out of court, and the complainant has no grievance or complaint. The defacto complainant Shamnad is the 3rd respondent herein. He has filed affidavit to the effect that he has settled the dispute with the accused, and he has no grievance or complaint. I am well satisfied that there is a real settlement between the parties. In such a situation continuance of prosecution will not serve any purpose rather than wasting the precious time of the court because nobody will support the prosecution when the case goes to trial. Crl.M.C. No.6907 of 2014 2 In the result this petition is allowed. The prosecution against the petitioners in CC 361/2014 of the Judicial First Class Magistrate Court -1, Nedumangad will stand quashed under Section 482 Cr.P.C. Accordingly the petitioners will stand released from prosecution, and the bail bond, if any, executed by them will stand discharged.
