Sri Manoj Kumar Gupta and Rajesh Kumar Verma, Advocate, have filed their Vakalatnama on behalf respondent no.3 today in Court, which is taken on record.
Heard Sri Sanjay Srivastava,learned counsel for the petitioner, Sri Manoj Kumar Gupta and Rajesh Kumar Verma, learned counsel for respondent no.3, Sri N.K.Verma, learned A.G.A. for the State and perused the impugned FIR as well as material brought on record.
This petition has been filed by the petitioner with a prayer to direct the respondent no.2 conclude the fair and impartial investigation of the case crime No.80 of 2017, under Sections 376, 352, 452, 506 I.P.C., Police Station Mahila Thana, District Bareilly and to arrest the accused persons.
It has been contended by learned counsel for the petitioner that the petitioner had lodged the present FIR against the accused respondent no.3 which was challenged by him before this Court by means of filing Crl. Misc. Writ Petition No.13947 of 2017 and the same was dismissed by Coordinate Bench of this Court vide order dated 26.7.2017, copy of which has been produced and the same is taken on record, but investigation of the case has not been concluded till date.
Considering the facts and circumstances of the case and submissions advanced by learned counsel for the parties, we direct the Investigating Officer of the present case to conclude the investigation of the present case and submit a police report before the Magistrate concerned expeditiously preferably within a period of two months from the date of production of a certified copy of this order.
It is further directed that the S.S.P., Bareilly shall supervise the investigation and ensure that the same is completed speedly without any undue delay.
With the above directions this petition is finally disposed of.
