This transfer application has been filed seeking transfer of Case No.636 of 2016 Ram Babu vs. Pushpa Devi (Annexure-9 of the Hindu Marriage Act), which is stated to pending consideration before the Family Court, Buland Shahar.
Counsel for the applicant admits that a divorce decree has already been passed between the parties.
In view of the statement so made, the case which is sought to be transferred has for all practical purposes been rendered infructuous. No decree for restitution of conjugal rights can be passed, once the parties have already been divorced.
Under the circumstances, this transfer application is dismissed as infructuous.
