Shilpi Gupta And Others vs The Registrar C.S.J.M.U. Kanpur ...

High Court Of Judicature at Allahabad|06 January, 2010

JUDGMENT / ORDER

The petitioners have filed this petition for a direction upon the Dr. Bhim Rao Ambedkar University, Agra (hereinafter referred to as the 'University') to issue B.Ed. Examination forms for the session 2007-08 and to permit them to appear at the examination.
It is stated in the writ petition that earlier the petitioners had been admitted in the Peetambar Degree College, Poiya Ghat, Agra pursuant to the counselling but ultimately as the said College was not affiliated to the University, they were transferred to the P.C. Bagla Degree College, Hathras which is affiliated to the University but the said College wrote a letter to the University seeking instructions as to whether they can be permitted to appear at the examination since they did not complete 180 days of teaching provided for in the guidelines issued by the National Council for Teachers Education. It is also stated that the Registrar of the University has informed the Principal that the College may take action in accordance with the guidelines issued by the National Council for Teachers Education.
Learned counsel for the petitioners submitted that the petitioners had earlier studied in Peetamber Degree College, Agra and it is only when it was revealed that the said College was not affiliated to the University that they were transferred to the P.C. Bagla Degree College, Hathras and, therefore, the classes attended by them in the earlier College should also be taken into consideration while calculating the number of days of teaching but this has not been done.
Sri Sanjay Kumar Singh, learned counsel appearing for the respondent-University states that the Registrar shall now pass an appropriate order expeditiously.
In view of the aforesaid, this petition is disposed of with a direction to the Registrar of the University to pass an appropriate order expeditiously, preferably within a period of one week from the date of filing of a certified copy of this order.
It is made clear that this Court has not adjudicated upon the merits of the case, which shall be considered by the Registrar of the University in accordance with law.
