THIS PETITION IS COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP ORDERS, THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER In the instant petition, petitioner has sought for the following relief:
Issue a writ of mandamus directing the respondent Nos.1 and 2 consider the representation vide Annexures A, A1 and A2 in accordance with law.
2. Pursuant to the advertisement for various posts, petitioner is one of the candidate for the recruitment to the post of Assistant Environment Officer. Notification was subject matter in Writ appeal No.2703/2011. which was decided on 19.4.2012.
3. In para No.6, it is observed that ‘Respondents are permitted fill up 56 Assistant Environmental Officers.’ The respondents have finalized the select list and so also, issued order of appointment to only 52 posts of Assistant Environment Officers. In respect of remaining four posts, documents are silent. The petitioner’s name appears at Sl. No.1 in the Supplementary list. Supplementary list has not been operated obviously all 52 candidates who were selected and appointed have reported for duty. The question for consideration is ‘why respondents have not filled up the remaining four posts?’. In this regard, concerned respondent is hereby directed to take a decision and pass speaking order and communicate to the petitioner as to why petitioner’s name has not been considered for selection and appointment to the post of Assistant Environmental Officer against remaining four posts. Such decision shall be taken by the concerned respondent within a period of two months from the date of receipt of this order and communicate the decision to the petitioner.
Writ petition stands disposed of.
