Heard learned counsel for the petitioner and Sri Vivek Varma for respondent-University.
The present petition has been filed for direction upon the respondents to verify the petitioner's graduation level degree by disclosing as to whether the English subject was a compulsory or an elective subject taken by the petitioner.
It appears that the petitioner has applied for appointment as an TGT teacher (English) for which one of the essential qualification, in the alternative, is that he should possess Bachelor degree with English as an elective subject at degree level.
The mark-sheet provided to the petitioner for Bachelor of Arts by Dr. Bhimrao Ambedkar University, Agra reflects as many as four subjects, namely, General English; Hindi Literature; Sociology; and Education.
The petitioner contends that English was an elective subject and therefore if the degree obtained by the petitioner is verified in the manner as prayed for by the petitioner, then her purpose would be served for gaining eligibility for appointment as an TGT teacher (English).
Sri Vivek Varma, who appears for respondents 1 and 2, submits that prior to 1st July, 2017, at the graduation level, General English was a compulsory subject and not an elective subject.
Be that as it may, as the petitioner has sought clarification in respect of degree which she has obtained, such clarification can always be provided by the University which has provided the degree by examining its own ordinances, statutes, etc. governing the issue. Accordingly, this petition is disposed off by requiring the Examination Controller of the University to clear the confusion by providing a clarificatory certificate as to whether the degree relates to General English as an elective subject or compulsory subject upon submission of documents along with certified copy of this order by the petitioner before him. Such clarification shall be provided within a period of three weeks from the date of submission of documents.
