JUDGMENT / ORDER

Petitioner's grievance is with respect to the rejection of application for transfer of ownership made by the RTO. Vehicle bearing Reg.No.KL-14/D 8103 was admittedly purchased by the petitioner in an auction conducted by the Excise Department. Ext.P1 is the proceedings of the Deputy Commissioner of Excise, Kannur, wherein the above vehicle, confiscated in an excise crime, was transferred to the petitioner on the basis of the successful bid made by the petitioner in a public auction.
2. The controversy arose when the engine number disclosed in the application for transfer submitted by the petitioner was not tallying with the actual engine number, as disclosed in the report of physical inspection. The Deputy Commissioner of Excise, by Ext.P2, intimated the RTO, the details of the vehicle. The transport authority W.P.(C)No.5397 of 2012 -:2:-
refused to register the transfer of ownership, for the reason that the engine was altered after purchase from the Government. This Court cannot issue any direction to register the vehicle, since, admittedly, the engine number found in the vehicle and that in the application differs.
The writ petition is dismissed, reserving liberty to the petitioner to apply for alteration or otherwise to get transfer of the vehicle, in accordance with law. No cost.
