JUDGMENT / ORDER

Ashok Bhushan, Ag.C.J.
Heard learned counsel for the petitioner, learned counsel appearing for the additional 5th respondent as well as learned Government Pleader.
2. The petitioner has come up with this writ petition praying for a direction to respondents 1 and 2 to afford adequate and effective police protection for the smooth functioning of the petitioner's unit in the event of any obstruction from the members of respondents 3 and 4 unions. Notices were issued to respondents 3 and 4, but no one appeared when the matter was taken up today.
3. Petitioner's case is that the area in which his unit situates is not a scheme covered area, which is not disputed by the counsel appearing for the additional respondent No.5, the Headload Workers Welfare Fund Board. Learned counsel for the petitioner submits that he has already engaged his own workers for doing the work in his unit, but respondents 3 and 4 Unions are obstructing, who has no authority to interfere.

Looking into the facts and circumstances of the case and the submissions made by both the sides, we dispose of the Writ Petition with a direction to respondents 1 and 2 to ensure that no obstruction is created by respondents 3 and 4 in carrying out the work by engaging petitioner's own workers.
