It is reported that the petitioner has already reinstated the respondent workman pending the final hearing of the petition.
The petition has been admitted vide order dated 4.5.2011 and notice as to interim relief is issued.
Therefore, now, the issue which remains, at this stage, is with regard to the interim relief.
The Court has stayed the operation of the award subject to compliance of requirement prescribed U/s.17B, however, as mentioned above, the petitioner has already reinstated the respondent workman and that therefore, at present, the question of complying with the requirement U/s.17B does not survive/arise.
In view of the said order dated 4.5.2011, the direction qua payment of backwages is already stayed since interim relief has been granted in terms of para-13(B).
In that view of the matter, the office is directed to list the petition in due course in the cause list for Final Hearing, as per its seniority.
