Petitioner's vehicle bearing registration No. KL- 10U/9680 has been seized alleging transportation of river sand without permit. A crime has been registered against the petitioners in this regard as Crime No.527/2014 of Vazhakkad Police Station. Petitioner seeks interim custody of the vehicle. 2. In view of the alternate remedy available before the competent jurisdictional magistrate under Section 23A of the Kerala Protection of River Banks and Regulation of Removal of Sand Act, 2001, the 2nd respondent shall report seizure of the vehicle within three days from the date of receipt of a copy of this judgment. If the petitioner moves an application before the competent jurisdictional magistrate, competent jurisdictional magistrate shall consider the application -2-
W.P.(C). No. 31617 of 2014 within ten days of moving such application. The first respondent is directed to finalise the confiscation proceedings within a period of two months.
The writ petition is disposed of accordingly.
