Petition filed under Section 438 Cr.P.C. 2. The petitioner is a minor student. The allegations against him is that by riding a motor cycle he attempted to knock down one Habeeb and thus committed the offence under Section 308 I.P.C.
3. Heard the learned counsel for the petitioner and the learned Public Prosecutor.
4. Under the Juvenile Justice (Care and Protection of Children) Act, 2000, a juvenile cannot be sent to jail. Having regard to the facts of the case, I do not think that it is proper for this Court to invoke the jurisdiction of this Court under Section 438 Cr.P.C.
In the result, this application is dismissed.
