This is a petition filed under Section 227 of the Constitution of India seeking a direction to the Munsiff Court, Paravur to take up and dispose of O.S.No.127/2014 pending before the said court. The facts necessary for the disposal of this O.P are as follows. 2. The petitioner filed O.S.No.127/2014 seeking a declaration that he is the son of the defendant and for other consequential reliefs. The grievance is that in spite of passage of seven months after the filing of the suit, no written statement is seen filed and in the plaint it is alleged that the defendant has dispute with regard to paternity of the plaintiff. The petitioner would say that in the light of the fact that written statement is not filed, he cannot take further steps in the matter and the defendant is of advanced age. It is further pointed out that the case was posted on 30.09.2014 finally for filing written statement

and on that day also, written statement was not filed and the matter is posted to a date after one month. The contention is that the matter is intentionally dragged on with ulterior motive.
3. In the nature of the order I propose to pass, it is felt that notice to the respondent is unnecessary.
The original petition is disposed of directing the court below to insist that written statement in the suit shall be filed on or before the next posting date and the court below may make every endeavour to dispose of the suit as expeditiously as possible.
