JUDGMENT / ORDER

The petitioner herein is the sole accused in C.C. No.72/2004 of the Judicial First Class Magistrate Court, Ernakulam. Crime in the said case was registered on the complaint of one Raveendran Pillai, under Sections 468, 406 and 420 IPC. The petitioner now seeks orders quashing the prosecution, on the ground that he and the complainant have come to terms amicably out of court. The defacto complainant, Raveendran Pillai is the 2nd respondent herein. He has filed affidavit to the effect that he has settled the dispute with the accused, and he has no grievance or complaint. I am well satisfied that the dispute between the parties is purely personal in nature, and that the parties have really come to terms amicably out of court. Continuance of prosecution in such a situation will be a sheer waste of time, if the case goes to trial. In the result, this petition is allowed. The prosecution against the petitioners as C.C. No.72/2014 before the Judicial Crl.M.C.. No. 7077/2014 2 First Class Magistrate Court, Ernakulam, will stand quashed under Section 482 Cr.P.C. Accordingly, the petitioner will stand released from prosecution. The bail bond, if any, executed by the petitioner will stand discharged.
