Heard Sri Vishal Agarwal, learned counsel for the petitioner and Sri learned Standing Counsel for respondents no.1, 2 and 3.
It appears that the petitioner took some loan from the respondents no.4 and 5 by mortgaging his property. Now he is facing recovery proceedings under Securitization and Reconstruction of Financial Assets and Enforcement of Securities Act and the matter is pending consideration under Section 14 of the Act before the respondent no.3.
Learned counsel for the petitioner states that the petitioner is ready and willing to pay the entire amount as demanded provided installments are fixed. He is ready to declare the dues so as to save his secured assets.
In view of the aforesaid facts and circumstances, coupled with the fact that the petitioner has borrowed money from a private financial institution, we do not feel inclined to exercise our discretionary jurisdiction and dispose off the petition with liberty to the petitioner to approach the respondent no.4 with his offer to pay the entire dues in installments. In case such offer is made by the petitioner within a period of two weeks, it shall be considered in accordance with law most expeditiously.
