Heard learned counsel for the petitioner and Shri Manoj Kumar Yadav, for the respondent no.9 Gaon Sabha as also learned Standing Counsel for the State-respondents.
The writ petition has been filed seeking the following relief-
"I) A writ, order or direction in the nature of mandamus directing the Sub Divisional Magistrate, Tehsil Machhalishahar, District Jaunpur/ Respondent no.2 to decide the suit No.T201914360302097 of 2019 (Shet Bhadur and others Vs. Om Prakash and others), under Section 116 of U.P. Revenue Code, 2006 village Chitanv, Pargana Mungra, Tehsil Machhalishahar, District Jaunpur within stipulated period as prescribed by this Hon'ble Court."
It is submitted that the partition suit was filed in the year 2019 and the opposite party therein have been served.
The writ petition is disposed of with the observation that the Court concerned may endeavour to decide the suit as expeditiously as possible.
It is, however, provided that the similar matters, which have remained pending for a longer period, must necessarily be afforded preference.
