Heard learned counsel for the petitioner and Shri Apurva Hajela, learned Standing Counsel. Shri R.C. Upadhyay has accepted notice on behalf of respondent no.7.
Learned counsel for the petitioner has confined his prayer for a direction to second respondent to decide Appeal No.224/A/C 20181500000275/2018 under Section 13 (1) of E.C. Act, 2016 (Shesh Nath Pandey v. District Supply Officer, Azamgarh) within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of asking the appellate authority to decide the aforesaid appeal in question in accordance with law expeditiously and preferably within three weeks from the date of production of certified copy of this order but certainly after giving opportunity to the parties concerned. Meanwhile, if any third party interest is created in the matter, the same shall be subject to final outcome of the appeal in question.
