Heard learned counsel for the petitioner, learned Standing Counsel for the State-respondents and Sri Mahboob Ahmad, learned counsel appearing for the Power Corporation.
By means of this writ petition, the petitioner has come up to this Court seeking a direction to the respondent no. 3 to remove the electric wires of 11000 volt running above the roof of the house of the petitioner.
Sri Mahboob Ahmad, learned counsel for respondent no. 3, submits that the 11000 voltage wires were already there when the petitioner started construction in the year 2011. Now he cannot claim that the wires be removed. Be that as it may. The petitioner claims to have made a representation to the Up-Ziladhikari, Meja, District Allahabad (respondent no. 2), which is to be pending.
Learned counsel for the respondent further submits that under the Rule known as "The Works of Licensees Rules, 2006", Rule 31 provides that such complaint can be made to the District Magistrate, who is the competent authority, thereafter he will look into the matter and pass a appropriate orders.
The writ petition is disposed off with the observation that in case the petitioner makes a representation under the aforesaid Rule before the concerned District Magistrate he will consider the claim of the petitioner and and pass appropriate orders in accordance with law.
With the aforesaid observation/direction, the writ petition stands disposed off.
