The petitioner herein is the defacto complainant in crime No.702/2013 of the Vadakara Police Station. He brought this petition for a writ of mandamus directing the second respondent to handover investigation of a crime to the Crime Branch (CBCID). His grievance is that the accused was granted bail by the Investigating Officer during investigation, and that even after incorporating Section 326 IPC on the basis of materials the Investigating Officer did not arrest the accused. 2. That the accused was released on bail he is not a ground to direct investigation by somebody else. So also the fact that the Investigating Officer did not make arrest of the accused cannot be a reason or ground to order investigation by somebody else. Now it is submitted by the learned Public Prosecutor that investigation is already over, and that the police has already submitted final report in court. In such a factual situation, this court cannot issue a writ of mandamus directing investigation by some other officer.
In the result, this writ petition is dismissed.
