JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) By way of this application, the applicant-convict who is a lady, has prayed that she be enlarged on temporary bail since her daughter is pregnant by 8 months and is expecting the delivery of a child.
Pursuant to the earlier order passed by this Court on 23.03.2012, the learned APP, Shri Pandya has submitted, based on the report which he has received from Police Sub Inspector, Amirgadh Police Station, that the ground mentioned in application is genuine. However, the daughter of the convict is at her in-laws' place in Rajasthan and the child is to be delivered there.
Under these circumstances, this application is not considered at this stage. However, it is observed that as and when the daughter of the applicant-convict delivers a child, the applicant may move an application, which may be considered on its own merits.
Subject to the aforesaid observations, the application is dismissed. Rule discharged.
