Learned counsel for the appellant is present. Ms. Manju Thakur, learned A.G.A., appearing for the State is also present.
This appeal has been preferred by the appellants against the judgment and order dated 25.1.1986, passed by Sessions Judge, Farrukhabad, in Sessions Trial No.506 of 1983 (State vs. Sher Singh and another), Police Station-Kannauj, District- Farrukhabad, whereby the appellant was convicted and sentenced to imprisonment for life under Sections 302/34 IPC.
Learned A.G.A. has submitted that as per report of the C.J.M., Farrukhabad dated 23.2.2019, Sher Singh s/o Cheda Lal Yadav, the appellant has died, and in view of the above, this appeal is liable to be dismissed as abated.
We have heard learned A.G.A., perused the judgment on record and scanned the lower court record very carefully.
The submission made by learned A.G.A. appears to be correct.
In view of the above, this appeal is liable to be dismissed as abated.
The appeal is dismissed, accordingly.
