Case :- CRIMINAL REVISION No. - 2035 of 2002 Revisionist :- Sher Singh Opposite Party :- State of U.P. and Others Counsel for Revisionist :- Rajul Bhargava Counsel for Opposite Party :- Govt. Advocate
Hon'ble Manish Kumar,J.
Case called out in the revised list. No one is present on behalf of the revisionist to press this revision.
Learned A.G.A. for the State is present and perused the record.
Despite the office report dated 19.12.2019, the notice was personally served upon the revisionist and as per the report of the C.J.M., Mathura dated 14.12.2017. The present criminal revision has been preferred against the judgment and order dated 18.11.2002 passed by Special Additional Sessions Judge, Mathura in S.T. No.360 of 1993 acquitting the respondent nos. 2, 3 and 4 of all the charges under Sections 148, 307/149, 323, 149, 323 and 149 of I.P.C.
From a perusal of the record, it appears that due to efflux of time, the present revision has become infructuous.
Accordingly, the present revision is dismissed as infructuous. Interim order, if any, stands vacated.
Office is directed to send a certified copy of this order to the trial court concerned which may proceed in accordance with law, if any further action is required.
It is made clear that it is open for the revisionist to move appropriate application before this Court within three months from today, if the matter survives.
