Heard learned counsel for the applicants and learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed to quash the charge sheet No. 72 of 2018 and entire criminal proceeding of Case Crime No. 69 of 2018, under Sections 323, 504, 506 I.P.C. and Section 3(1)(dha) of SC/ST Act, P.S. Khurja Dehat District Bulandshahar pending in the court of II Additional District & Sessions Judge/ Special Judge SC/ST (P.A.) Act, Bulandshahar.
Learned counsel for the applicants submits that no offence against the applicants is made out. They have been falsely implicated by the police under the alleged sections.
In that view of the matter, they are permitted to move discharge application within one month from today through counsel before the Trial Court and the Trial Court shall decide the same within a period of two months from the date of filing of application along with certified copy of this order.
Till the discharge application is decided, no coercive measures shall be taken against the applicants.
With the aforesaid direction,the application is disposed of.
