Sri Ram Nath, learned counsel for the petitioner and Sri A K Shukla, learned AGA for the State.
This writ petition has been filed by the petitioner seeking direction to the police authorities to conduct fair, proper and impartial investigation in respect of Crime No.905 of 2019 for the offence under Sections 363, 366, 120-B of IPC, P.S. Kotwali Chhibramau, District Kannauj.
According to the petitioner, on 13.12.2019, he lodged a report against respondent no.4 and his mother under Section 364 of IPC, but till date nothing has been done by the police. Learned counsel submits that a direction may be issued to the police authorities to investigate the matter fairly and impartially.
State counsel submits that the police authorities are under an obligation to do the investigation fairly, impartially and expeditiously and the same would be done in accordance with law.
The present petition is disposed of, directing the police authorities to conclude the investigation of the said case expeditiously and preferably within a period of three months from the date of production of a copy of this order in accordance with law on the basis of evidence so collected, if not already concluded.
It is made clear that we have not expressed any opinion on merits of the case.
