Sheik Mohammed Ali vs Tamil Nadu State Transport

Madras High Court|06 June, 2017

JUDGMENT / ORDER

This Writ Petition has been filed by the petitioner for issuance of a Writ of Mandamus, directing the first respondent to dispose the petitioner's appeal dated 11.04.2017.
2. The petitioner was employed as Senior Assistant Engineer, at Usilampatti Branch of first respondent Corporation. Though the petitioner was dismissed from service by an order dated 26.02.2016, he preferred an appeal dated 11.04.2017 to the first respondent.
3. The grievance of the petitioner is that, he is out of employment and so, he filed an appeal on 11.04.2017, which is yet to be disposed of. Hence the learned Counsel for the petitioner would submit that a direction may be given to the appellate authority namely the first respondent, to dispose of his appeal, dated 11.04.2017, to meet the ends of justice.
4. Considering the limited scope of the prayer now sought for before this Court, this Court is inclined to issue the following direction:
4.1.The first respondent is directed to dispose of the petitioner's appeal dated 11.04.2017, on merits and in accordance with law within a period of eight weeks from the date of receipt of copy of this order.
5.With the above direction, this Writ Petition is disposed of. No costs.
