JUDGMENT / ORDER

~ ~ ~ ~ ~ ~ Petition filed under Section 438 Cr.P.C. 2. Petitioner is the accused in Crime No.1950/2014 of Kunnamkulam Police Station, Thrissur registered for the offences punishable under Sections 341,506(ii) and 307 of the Indian Penal Code.

The allegation against the petitioner is that on 23/8/2014 at 10.30 a.m., the petitioner called the defacto complainant out of a fast food shop at Chirakkal centre and stabbed the defacto complainant with a knife. When it was warded off , the petitioner took a rubble from the road and repeatedly hit with it on the head of the defacto complainant, thereby causing serious injuries.
4. Heard learned counsel for the petitioner and the learned Public Prosecutor. According to the learned counsel for the petitioner, it is a case of false implication on account of B.A. No.6825/2014 2 political enmity. On a perusal of the copy of the wound certificate in the CD, it could be seen that the defacto complainant has sustained very serious injuries. He has sustained injuries on the left side of his forehead and also another serious injury on the scalp, along with other abrasions. Investigation of this case is not over. The contents of the C.D prima facie reveal the complicity of the petitioner. In a case like this, the custodial interrogation of the petitioner is required for the continued investigation of this case. Matters being so, this is not a fit case wherein anticipatory bail can be granted to the petitioner.
In the result, this Anticipatory Bail Application is dismissed.
