Heard Sri Santosh Mani Shukla, learned counsel for applicant, Sri Ghanshyam Kumar, learned A.G.A. and perused the record.
This application under Section 482 Cr.P.C has been preferred for an appropriate direction to the Trial Court i.e. Additional Civil Judge (Sr. Div.), Court No. 2, Jaunpur to decide the Criminal Complaint Case No. 485 of 2016 (Sheetla Prashad Tiwari versus Sunil Kumar Pandey, under Section 138 of N.I. Act, Police Station Kotwali, District Jaunpur, expeditiously within time bound period fixed by this Hon'ble Court.
Learned counsel for the applicant contended that the above refereed case is pending since 2016. Due to pendency of above case for a long time, applicant is suffering inconvenience and irreparable loss. In view of above, this application be allowed and Court below be directed to decide the case expeditiously within the time frame fixed by this Court.
Learned AGA has no objection to issue an appropriate direction in the matter.
Perusal of order sheet (Annexure-2) reveals that since for a long period this case has been fixed continuously for S/C (?).
In view of above, it is provided that the Court below will decide the case expeditiously preferably within a period of six months from the date of production of certified copy of this order, without granting any unnecessary adjournment to any party and if adjournment is inevitable that may be subject to heavy cost and for short dates.
With the aforesaid observation/direction, this application is finally disposed of.
