Supplementary-Affidavit has been filed by learned counsel for the petitioners and the same is taken on record.
Heard Sri Anuj Bajpai, learned counsel for the petitioners, Sri Vikas Sahai, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer to quash the F.I.R. dated 18.04.2018 registered as case crime No. 169 of 2018 under section 365 I.P.C., police station Sindholi South, District Shahjahanpur.
Learned counsel for the petitioners submitted that respondent No.3 who is stated to be Dhan Pal Singh appears to have been wrongly mentioned in the F.I.R. as he is actually known by name Dhan Pal Verma. It is further argued by learned counsel for the petitioner that petitioner No.1 is the victim of the case who is the daughter of respondent No.3 and she is living with petitioner No.2. The present F.I.R. has been lodged by respondent No.3 for the abduction of his daughter, is false. It is next contended that the victim is major as it appears from the High School Certificate.
Learned A.G.A. opposed the prayer for quashing.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioners shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but he shall co-operate with the investigation of the case.
With the above direction this petition is finally disposed of.
