Heard Sri Rajesh Kumar, learned counsel for the petitioner and learned Standing Counsel for the respondents-State.
Notice need not be sent to private respondents, at this stage.
The sole prayer in the writ petition is to decide the Case No.02528 of 2019, Computerized Case No.T201915060202528, Somaru Vs. Sheela, under Section 35 (2) of U.P. Revenue Code, 2006 expeditiously.
As no useful purpose would be served in keeping the matter pending, with the consent of the parties, the matter is being disposed of at this stage without calling for counter affidavit or issuing notice to private respondents, with a direction upon respondent no.2-Sub Divisional Magistrate, Nizamabad, Azamgarh to decide Case No.02528 of 2019, Computerized Case No.T201915060202528, Somaru Vs. Sheela, under Section 35 (2) of U.P. Revenue Code, 2006, if there is no legal impediment and after hearing all the concerned parties, strictly in accordance with law by reasoned and speaking order, expeditiously, preferably within a period of four months from the date of production of copy of this order, downloaded from the official website of Allahabad High Court.
