Shesh Nath Singh vs Managing Director/

High Court Of Judicature at Allahabad|27 April, 2018

JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 10732 of 2015 Petitioner :- Shesh Nath Singh Respondent :- Managing Director/ Hon'Ble Governing Council U.P. And 3 Ors.
Counsel for Petitioner :- Prashant Singh 'Som'
Counsel for Respondent :- Mohit Singh,Satyam Singh,Shiv Nath Singh
Hon'ble Sudhir Agarwal,J. Hon'ble Bachchoo Lal,J.
1. Case called out. None appeared on behalf of petitioner. Sri Shiv Nath Singh, learned counsel for the respondents is present. However, we ourselves have perused the record.
2. By means of the present writ petition, petitioner has sought the following reliefs :
"i) Issue a writ of Certiorari quashing the order dated 27.5.2013 passed by respondent no. 3 as well as order dated 25.11.2006 passed by respondent no. 1, annexure no. 6, to this writ petition.
ii) Issue a writ, order or direction in the nature of Mandamus commanding the respondents to pay the salary of suspension period with interest within stipulated period as may be fixed by this Hon'ble Court."
3. However, we ourselves have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or that petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for the petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
Order Date :- 27.4.2018/Gss
