Heard learned counsel for the petitioner and Ms. Bushra Mairyam who appears for the contesting respondents.
The sole prayer addressed on this petition is for the grant of Assured Career Progression benefits to the petitioner.
From the disclosures made by the respondents in response to an application under the Right to Information Act, 2005 by the petitioner, it is evident that two orders of punishment came to be made against the petitioner on 29 November 2016 and 08 March 2017. In terms of the order of 08 March 2017 two annual increments of the petitioner were stopped for a period of two years. Learned counsel for the petitioner fairly concedes that the effect of this punishment would come to an end only upon the expiry of the period of two years. This petition evidently came to be filed even before this period of two years had expired. In view of the above Ms. Bushra Mariyam learned counsel appearing for the respondents states that on the date when the petition was presented, it could not be said that the petitioner had satisfactory service so as to be entitled to the grant of ACP bebnefits. She however states on instructions that upon the effect of these two orders of punishment coming to an end, the claim of the petitioner for grant of ACP benefits shall be duly attended to and disposed of in accordance with law.
In view of the above, this petition shall stand disposed of in light of the statements noted above.
