Heard learned counsel for the petitioner, learned Standing Counsel for the State authorities and Sri Saurabh Tiwari, learned counsel for the respondent no.4.
While entertaining the writ petition following orders were passed on 7.11.2019:-
"The petitioner is raising a dispute to the effect that he is not getting revised/amended pension as per the order dated 17.9.2018 issued by the Additional Director, Local Funds Audit and Accounts, U.P., Allahabad and the pension is being paid to him at the old fixation.
The matter requires consideration.
Learned Standing Counsel appears for respondent nos. 1 to 3 prays for and is granted three weeks time to seeks instructions to bring the order of the competent authority for release of revised pension fixed by the order dated 17.9.2018 passed by respondent no. 2.
The Commissioner, Aligarh Division, Aligarh shall be under obligation to seek necessary instructions from the Executive Officer, Nagar Panchayat, Sasni, District Hathras in the matter of release of revised pension to the petitoner as per the order dated 17.9.2018 passed by the Additional Director, Local Funds Audit and Accounts, U.P., Allahabad.
A short counter affidavit be filed on the next date fixed. Put up this matter on 29.11.2019 as fresh."
A short counter affidavit has been filed on behalf of respondent no.4 stating that petitioner's claim has already been processed and forwarded by the District Magistrate, Hathras to the Divisional Commissioner on 27.11.2019. It is stated that petitioner's claim would be duly addressed, expeditiously.
In view of the stand taken by the respondents, this writ petition stands disposed of with a direction upon the respondents to ensure that entire withheld retiral benefits due and payable to petitioner is credited to his account, within a period of two months from the date of presentation of certified copy of this order.
