Heard learned counsel for petitioner, learned A.G.A.and Sri Pranjal Mehrotra, for respondent no.2.
This petition is filed by the petitioner for quashing the proceeding of Case No.422 of 2017 arising out of case crime no.104 of 2017 (State Vs. Shawez) as well as the charge sheet dated 7.4.2017 u/s 135 of Indian Electricity Act, 2003.
Learned counsel for petitioner submits that the petitioner has already deposited the entire amount pursuant to the assessment letter dated 25.4.2017 and the copy of the receipt has been filed as Annexure-3 to the affidavit accompanying the application.
In view thereof, in case a compounding application is filed within two weeks from today, the Court below shall consider and decide the same in accordance with law within six weeks thereafter.
For a period of eight weeks, no coercive action shall be taken against the petitioner.
With the aforesaid, the petition is disposed of.
