Heard learned counsel for the petitioner, learned AGA for the State and perused the impugned F.I.R. as well as material brought on record.
Sri J.P. Mishra, Advocate has filed counter affidavit on behalf of the respondent no.3, wherein it has been mentioned in para nos.4,5, and 6 that parties have entered into compromise and deponent Anna-respondent no.3 does not want to litigate the matter any further.
In view of the aforesaid facts and circumstances of the case and also in view of the statement made in para nos. 4,5, 6 of the counter affidavit, no purpose would be served in keeping the present case pending before this Court. Accordingly the instant writ petition is allowed and the impugned FIR registered as Case Crime No. 139 of 2016 u/s 498A, 323, 376-D, 506 IPC and 3/4 D.P. Act, P.S. Mahila Thana, District Muzaffarnagar is hereby quashed.
A copy of this order shall be forwarded to the Government Advocate for necessary compliance.
This order has been passed in presence of both the counsels.
