This writ petition has been filed for the following relief:
(a) Issue a writ, order or direction in the nature of certiorari to quash the notice dated 16.05.2017 issued by respondent No. 2.
In the facts and circumstances of the case, we are of the opinion that grievance of the petitioner against the provisional assessment is required to be addressed by the competent authority.
It is accordingly provided that the petitioner may file his objection to the notice within a period of 15 days from today and may appear before the Executive Engineer on 10.09.2018 along with evidence available with him.
In case, the objections/reply are filed, the same shall be considered and decided within a period of 30 days from the date of receipt of certified copy of this order.
For a period of 45 days from today or till the date of final disposal of the objection/reply, whichever is earlier, no coercive action shall be taken against the petitioner.
With the aforesaid directions, the writ petition is disposed of.
