The petitioners were ordered to be evicted by an order dated 23.04.2018, against which they filed the instant writ petition saying that the order dated 23.04.2018 was ex-parte and made a prayer that the recall application for the recalling of the order dated 23.04.2018 be decided expeditiously. However, counsel for the respondent no. 5 has made a statement that the order dated 23.04.2018 had been implemented and the 'Rasta' had been cleared after the encroachment had been removed.
Under such circumstances, it is being directed that the restoration application would be decided expeditiously within a period of one week from the date of presentation of a certified copy of this order. If the order is recalled, the case under Section 67 shall be heard again. Order shall be passed after hearing of the petitioners, the Gaon Sabha, State of U.P. and the complainant.
