Heard learned counsel for the petitioner, learned AGA for the State- respondents and perused the record.
Instant writ petition seeks quashing of the FIR dated 10.1.2018, registered as Case Crime No. 0009 of 2018, at P.S. Rajpur, District Ramabai Nagar (Kanpur Dehat), Under Section 60 of UP Excise Act.
It appears that due to some mistake FIR was registered for offence punishable under Section 60 of the Excise Act though as per FIR 'Bhang' was said to have been recovered.
Pursuant to our order dated 18.1.2019, learned AGA has obtained instructions and informed the Court that charging section has been corrected and now Section 20 of N.D.P.S. Act has been added and the F.S.L. report has confirmed that the material recovered was 'Ganja'.
Under the circumstances, no case to quash the FIR is made out. The writ petition is dismissed.
