Heard Sri Bimla Prasad, learned counsel for the petitioners.
The petitioner No.1 is working as a Forest Ranger. An order of punishment has been passed against him on 30.03.2017. The appeal of the petitioner No.1 against the said order has been dismissed by the office order dated 09.01.2018.
The above orders have been challenged by the petitioners by means of this writ petition.
We do not find any reason for the petitioner No.2 to challenge the above orders as they are directed only against petitioner No.1.
The pleadings of the writ petition do not even reveal how petitioner No.2 is aggrieved and affected.
In view of the above, petitioner No.2 has no locus standi to join the petitioner No.1 in filing this writ petition.
The petitioner No.1 can challenge the above orders by filing a claim petition under Section 4 of the U.P. Public Services (Tribunal) Act, 1976.
In view of the statutory alternate remedy so available to the petitioner more particularly as the matter involves disputed questions of fact, we do not deem it proper to entertain the petition.
The Writ Petition is dismissed on the ground of alternate remedy.
