Learned APP, Mr.Pandya, waives service of rule on behalf of respondent-State.
By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail on the ground that the operation of his wife for gynec problem is to be performed.
From the material which is annexed with the application, we find that no date of operation is fixed.
Under the circumstances, the application is not entertained at this stage. However, it is observed that as and when the operation is performed and if application is preferred, the same shall be considered on its own merits.
Subject to above observation, the application is not granted at this stage. Rule discharged.
