The grievance of the petitioner is that the respondents no. 5 and 6 have made illegal encroachment on the public land.
It is stated that the petitioner has made a representation to the respondent no. 3 for taking action against the respondents no. 5 and 6 but no decision has been taken as yet.
We have heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
In view of the order passed, there is no need to issue notice to the respondents no. 5 and 6 as their rights have been protected by us in the present order.
Taking into the facts and circumstances of the case, we are of the view that the ends of justice requires that the grievance of the petitioner be considered by the third respondent, Sub- Divisional Magistrate, Tehsil Chunar, District Mirazapur in accordance with law, expeditiously. The third respondent before taking decision shall furnish the opportunity to the respondents no. 5 and 6, as early as possible, preferably, within three months.
With the aforesaid observation, the writ petition stands disposed off.
