Heard learned counsel for the parties.
It has been contended by the learned counsel for the petitioner that the petitioner has filed a complaint against the siting Pradhan before the respondent no. 2 District Magistrate, Ballia on 15.4.2017, copy whereof has been annexed as Annexure-4 to the writ petition under Rule 3(1) of Uttar Pradesh Panchayat Raj (Removal of Pradhans, Up-Pradhans and Members) Enquiry Rules, 1997 alleging commission of financial irregularities by him in the discharge of his official duty.
He has further submitted that despite lapse of almost one year, no action has been taken by the respondent no. 2 District Magistrate, Ballia on the petitioner's complaint and hence, a suitable direction may be issued to the respondent no. 2 District Magistrate, Ballia to pass appropriate order on the complaint of the petitioner within a specified period.
Sri Ramesh Chandra Upadhyay, learned counsel appearing for the respondent no. 3 Gaon Panchayat and learned Standing counsel stated that they have no objection to the prayer made by learned counsel for the petitioner.
In view of the above, without expressing any opinion on merits, we dispose of the writ petition with direction to the respondent no. 2 District Magistrate, Ballia to pass appropriate order on the complaint moved by the petitioner before him on 15.4.2017 (Annexure-4) within a period of four weeks from the date of production of certified copy of this order before him.
