Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the State respondents and perused the record.
Present petition has been filed with following prayer:-
"i. issue a writ, order or direction in the nature of writ mandamus commanding to the respondent no.2 to decide and dispose of the suit No. D201903390002907 of 2019 (old No. 02907/ 2019) (Shashi Saxena vs. Ram Autar and others) under section 116 of U.P. Revenue Act 2006 for declaration of Gata No. 841 area 0.4520 hect. pending in the court of Up- Ziladhikari, Sadar, Kannauj within time bound period fixed by this Hon'ble Court, in the interest of justice.
ii. issue any other suitable writ, order of direction which this Hon'ble Court may deem fit and proper under the circumstances of the case.
iii. award the cost of the petitioner."
In the facts and circumstances of the case, the present petition is finally disposed of with the direction to the respondent no. 2 to expedite the hearing of the aforesaid case and decide the same on its own merit, in accordance with law, expeditiously preferably within a period of nine months from the date of production of self-verified copy of this order, provided there is no legal impediment and no unnecessary adjournments shall be granted to the parties and provided the functioning of the Court concerned is not affected due to any reason related to COVID- 19 Pandemic as well as the lawyers are not abstaining from the judicial work.
With the aforesaid observations/ directions, the present petition is finally disposed of.
