Heard learned counsel for the petitioner as well as learned counsel appearing for the respondents and perused the record.
Present petition has been filed with a prayer that the Court below i.e. 1st Additional Civil Judge, (Junior Division) Varanasi, District Varanasi be directed to expedite the hearing and decide the Suit No. 646 of 2012 (Shashi Prasad Goenka Vs. Amar Nath Singh) within a time bound period.
In the facts and circumstances of the case, the present petition is finally disposed of with the direction to the respondent no. 3 to expedite the hearing of the aforesaid case and decide the same on its own merit, in accordance with law, expeditiously.
With with aforesaid observations/directions, the present petition is finally disposed of.
