JUDGMENT / ORDER

Court No. - 7
Case :- WRIT - A No. - 17693 of 2018 Petitioner :- Shashi Pal Yadav Respondent :- State Of U.P. And 10 Others Counsel for Petitioner :- Agnihotri Kumar Tripathi Counsel for Respondent :- C.S.C.
Hon'ble Dinesh Kumar Singh,J.
The petitioner has filed this petition seeking a direction that the ad hoc teachers whose names are mentioned in the list (Annexure-1) should not be regularized.
When the Court put a question to the learned counsel for the petitioner that what right he has got to maintain this writ petition, the counsel submits that the petitioner is qualified to be appointed as teacher and if the ad hoc teachers are regularized, he will not be appointed against those vacancies. This is a very wild view which the petitioner has taken to maintain this petition. Mere having qualifications for a post does not vest a person with right to get appointed against that post.
This petition lacks any merit and substance and not maintainable as the petitioner does not have any right in law to have claim against the post for which the ad hoc teachers are likely to be regularized.
In view of the aforesaid, this petition is being dismissed without having any merit as well as on the ground that it is not maintainable.
