Heard learned counsel for the petitioners, Ms. Nitika Sharma, learned Standing Counsel for the State respondents and Shri Manoj Kumar Yadav, learned counsel for third respondent.
Notice need not be issued to the private respondent, in view of the order proposed to be passed.
The petitioners are before this Court with request to issue direction to the Nayab Tehsildar, Mugara, Tehsil Machhalishahar, Jaunpur to decide the Mutation Application/Case no.3226 of 2016/Computerized Case no.T2016143658033226 (Shashi Kumar and others vs. Ramesh Chandra) under Section 34 of U.P. Revenue Code 2006 with regard to Gata no.206 and 207 (Rakba 23x110 Fit) situated in Village Pakadi, Kasba Badshahpur Station Road, Pargana Mugara, Tehsil Machhalishahar, District Jaunpur on the basis of Registered Sale Dee dated 05.11.1982 in favour of petitioners, expeditiously.
Learned Standing Counsel and Shri Manoj Kumar Yadav, Advocate very fairly state that in case the aforesaid case is still pending, the same shall be considered and decided by the Authority concerned expeditiously.
In view of the above, without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, on consent, the writ petition is disposed of finally with a direction to the Nayab Tehsildar, Mugara, Tehsil Machhalishahar, Jaunpur to expedite the hearing of the aforesaid case and conclude the same expeditiously, preferably within a period of three months from the date of production of a certified copy of this order before him, without granting unnecessary adjournments to either of the parties, except upon payment of cost but certainly after according opportunity of hearing to all the stake holders in the matter.
