Petitioner claims to have been appointed as Anganwadi Karyakatri on 14.5.2007 and having undergone training etc. is allegedly working to the satisfaction of the respondents. Her grievance is that though she is entitled to promotion, yet her claim for promotion to the post of Mukhya Sewika has not been considered.
Learned Standing Counsel submits that in terms of circular issued, only those persons could be considered for promotion, who are less than 50 years of age and as the petitioner has exceeded minimum age, her claim for promotion has not been considered. The circular issued by the Director dated 9.1.2018 has been brought on record, as per which claim of promotion to the post of Mukhya Sewika has to be considered of such persons, who have completed 10 years service as on 1st July, 2017, and have not attained the age of 50 years on that date. Admittedly, petitioner had completed 10 years working and was below 50 years of age as on 1st of July, 2017. In such circumstances, petitioner's claim for promotion ought not to be discarded for the reason that she has exceeded 50 years of age.
In the facts and circumstances, this writ petition stands disposed of with a direction upon respondent no.2 to accord consideration to petitioner's claim for promotion to the post of Mukhya Sewika, in light of the observations made above, within a period of three months from the date of presentation of certified copy of this order.
