Shashi Kala Upadhyay vs Yogeshwar Ram Mishra

High Court Of Judicature at Allahabad|26 February, 2018
|

JUDGMENT / ORDER

Court No. - 59
Case :- CONTEMPT APPLICATION (CIVIL) No. - 1023 of 2018 Applicant :- Shashi Kala Upadhyay Opposite Party :- Yogeshwar Ram Mishra, District Magistrate And 7 Others Counsel for Applicant :- Ganesh Shanker Srivastava,Ashwini Kumar
Hon'ble Yashwant Varma,J.
Supplementary affidavit filed today on behalf of applicant is taken on record.
Heard learned counsel for the applicant.
In the writ petition preferred the learned Judge on 10.04.1998 proceeded to stay the order dated 27.03.1998 passed by the Deputy Director Consolidation.
The sole contention on which rests this petition of contempt is that the opposite parties are interfering with the possession of the applicant. The petition is clearly misconceived since there is no injunction passed by the High Court which may have been said to have been violated. The mere suspension in operation of the order passed by Deputy Director Consolidation also does not give rise to any circumstance to initiate proceedings in contempt.
In view of the above, contempt petition is dismissed.
Order Date :- 26.2.2018 S. Thakur
