It has been pointed out by Sri Rathore that the citation is in the name of Devendra Kumar Gupta and not the petitioner. Learned counsel for the petitioner submits that as a matter of fact it is the electricity connection of the petitioner but the citation has been wrongly issued in the name of the employee of the petitioner.
Be that as it may it has to be established on record and the writ petition against the citation would be maintainable only by the person who is named in the citation. Consequentially the writ petition can not be entertained without prejudice to the rights of the aggrieved person to file a fresh writ petition. The writ petition is consigned to records.
