Heard learned counsel for the applicants, learned AGA for the State and Sri Mohd. Aslam, learned counsel appearing on behalf of opposite party no.2.
Learned counsel for the applicants has handed over a demand draft No.083867 dated 27.11.2018 of Rs. 15 lakhs to the learned counsel for opposite party no.2. This demand draft has been drawn in favour of opposite party no2, Alok Verma. Learned counsel for the applicants submitted that opposite party no.2 had made payment by means of cheques issued by four persons. This fact has been admitted in para 5 of the supplementary affidavit filed by opposite party no.2.
In view of the averment made in para 5 of the supplementary affidavit, it is hereby provided that this demand draft will settle the dispute between the parties finally. No third party shall raise any claim regarding present dispute against the applicants in future. The liability of the applicants is finally settled so far as this case is concerned.
In view of the fact that the parties have settled their dispute, the proceedings of Case No.5021 of 2018, State Vs. Smt. Shashi Bansal and others, arising out of the impugned charge sheet dated 10.12.2016 in Case Crime No.328 of 2016, under Sections 420, 323, 504, 506 and 352 IPC, Police Station Fatehpur, District Saharanpur pending in the Court of learned A.C.J.M. 4th Saharanpur are hereby quashed.
Application stands allowed.
